Terms and Conditions of Tokyokarts
Introduction
Welcome to Tokyokarts, a premier photography agency based in Tokyo, Japan. These Terms and Conditions ("Terms") govern your access to and use of our services, including the booking of photographers, purchase of photographs, and any related services provided by Tokyokarts ("Services"). By engaging with Tokyokarts, you agree to comply with these Terms. If you do not agree, please refrain from using our Services.
Services
Tokyokarts provides professional photography services through a diverse network of photographers. We cover a wide range of events, including but not limited to corporate functions, weddings, cultural festivals, sports events, and private parties. Our photographers also create artistic and commercial photographs available for purchase.
Bookings

1. Request for Services: Clients can request photography services via our website, email, or by contacting our office directly.

2. Confirmation: Bookings are confirmed upon receipt of a written agreement and payment of any required deposit.

3. Changes and Cancellations:

   • Changes to bookings must be communicated at least 72 hours in advance and are subject to photographer availability.

   • Cancellations made more than 7 days prior to the event will receive a full refund, less any administrative fees. Cancellations made within 7 days are non-refundable.

Pricing and Payments

1. Pricing: Pricing varies based on the nature of the event, duration, location, and specific requirements. A detailed quote will be provided upon inquiry.

2. Payments:

   • A deposit (typically 50%) is required to secure a booking.

   • The remaining balance is due no later than the day of the event unless otherwise agreed upon in writing.

3. Late Payments: Late payments may incur additional charges.

Delivery of Work

1. Turnaround Time: Photographs will be delivered digitally within the agreed timeframe, typically 7-14 business days unless specified otherwise.

2. Format: High-resolution digital images will be shared via a secure online gallery or other agreed methods. Physical prints are available upon request and may incur additional charges.

3. Revisions: Clients may request minor edits to delivered work. Significant revisions may incur additional fees.

Intellectual Property

1. Ownership: All photographs remain the intellectual property of Tokyokarts and/or the individual photographer unless explicitly transferred in writing.

2. Usage Rights:

   • Clients are granted a non-exclusive, non-transferable license to use the photographs for personal or agreed-upon purposes.

   • Commercial use requires prior written consent and may incur additional fees.

3. Prohibited Uses: Clients may not resell, redistribute, or alter the photographs without prior permission from Tokyokarts.

Liability

1. Event Coverage: While Tokyokarts strives for complete coverage, we cannot guarantee specific shots or outcomes due to the nature of live events.

2. Damages: Tokyokarts is not liable for unforeseen circumstances, such as technical failures, natural disasters, or client-related delays, that affect the delivery of Services.

3. Maximum Liability: In the unlikely event of service failure, Tokyokarts’ liability is limited to a refund of the amount paid for the specific Services in question.

Client Responsibilities

1. Permissions: Clients are responsible for obtaining necessary permissions for photography at event venues.

2. Cooperation: Clients must provide accurate information and cooperate with photographers to ensure the desired results.

Privacy and Data Protection

1. Data Usage: Tokyokarts collects and uses client data solely for providing Services and improving client experience. We do not share personal data with third parties without consent.

2. Photograph Use: Tokyokarts may use selected photographs for promotional purposes unless the client opts out in writing prior to the event.

Governing Law
These Terms are governed by the laws of Japan. Any disputes arising from these Terms or the Services will be resolved under the exclusive jurisdiction of Tokyo courts.
Amendments
Tokyokarts reserves the right to amend these Terms at any time. Clients will be notified of significant changes.
